Dismissal of contracts formalized prior to the entry into force of this Royal Decree-Law will be calculated at the rate of 45 days of salary per year of service for the time of service prior to said effective date and at the rate of 33 days of salary per year of service for the time of service thereafter. The resulting indemnity amount may not exceed 720 days of salary, unless the calculation of the indemnity. The period prior to the entry into force of this Royal Decree-Law results in a higher number of days, in which case this will be applied as maximum compensation amount, without said amount being moible number data able to exceed 42 monthly payments, in any case. Previously, the compensation for unfair dismissal was calculated at the rate of 45 days of salary per year of service, with the exceptions of employment promotion. Contracts when the dismissal for objective reasons was classified as unfair, which was calculated at the rate of 33 days of salary per year of service. Article 18 of Royal Decree Law 3/2012 amended article 56.2 of the Workers' Statute , establishing that in the event that reinstatement is chosen, the worker will be entitled to processing wages (the money received by the dismissed person from the time of fires.
